2024-08-28Lot of 3 Battery’s for 8MM RCA Sanyo Sharp Sony Camcorder – Energizer/Duracell335246538862$4.99 + Shipping ($7.43)

This person purchased this lot of 3 camera batteries for vintage camcorders. None of these batteries were tested nor were they charged. The listing described this as such and was listed with sold as is. This buyer clearly knew what they were purchasing and fully understood the condition of the item.

Buyer had the item for nearly a month before they messaged us on September 17th 2024 explaining that 2 of the batteries seem “OK” but the 3rd one wasn’t up to par with them. They further ended the message with “I don’t mind keeping them all if you might be ok with doing a small partial refund, say $2 ? Or if you like I can go ahead and send them all 3 back for a full refund and you can then do whatever with them.”

We explained to them that they knew exactly what they purchased which was described in the listing and that we don’t do partial refunds. They proceeded to say that they would open a case and send them back to us.

About a week later on September 25th 2024 they opened a return case. At which we responded to them by again messaging them and telling them we are not able to accept a return under the conditions of the description. There were no errors on our part and they purchased an item fully knowing what it was and the condition.

After contacting eBay and letting them know about this abusive buyer. We were told that they would escalate the issue in our favor if and when the item is sent. The buyer never did send the item. They closed the return a day before it was to auto close. Which is when they gave us negative feedback which said the following:

One of 3 used (means working) batteries was a dud, Seller was MOST UN-caring and UN-helpful, I was going to send all 3 back though seller ARGUED they would NOT accept a return (listing DID SAY – Returns Accepted) nor do even a partial refund for the bad one, (I suggested a measly $2 back). But I kept them bc at least 2 out of the 3 seem to be OK, and the total sale price was still cheap enough. Would have cost more to send them back than what they’re worth. Though Ebay would have send me a label too

2024-09-202010 Fisher-Price Kids Tough Digital 4x Zoom Camera w/ USB Cable – Pink335568583454$14.99 + Shipping ($4.87)

This person purchased a “Fisher-Price Kids Tough Digital 4x Zoom Camera w/ USB Cable – Pink” which had a little bit of an odor to it. This was all described in the listing. The buyer apparently did not like the odor and attempted to return the item under false pretenses so they didn’t have to pay for shipping. Effectively committing abuse of returns under the buyers remorse act.

Aimee Matias opened up a return on 2024-09-20 claiming the item “Arrived Damaged”. Upon messaging them first and informing them that they did not open communication with us (the seller) prior to opening a return. We asked them for proof of damage with photos of the outside of the packaging. They refused and then claimed the item “turns on” and works but only “when the USB is plugged in”. They goes on to say that they used “new” batteries and that it still did not work.

We (the seller) told them that they are possibly using cheap batteries, inserted the batteries the wrong way or they are not holding the button down long enough to turn the unit on. He or She then proceeded to get rude and say that they wanted to return the item and get a full refund. We (the seller) proceeded to explain to them that their story changed twice and that if they were returning this item because of the odor. That would be considered abuse of returns and fall under remorse purchase. We politely told them that at that point if they still wanted to return the item that we would follow up with small claims to recoup our costs.

At that point we were proceeding to accept the return. However the return auto closed because this person opened a charge back with their credit card company. This is now a fraudulent case since they won’t be returning the item. They had already gotten their money back in full. We reached out to them one last time to demand they send the item back to us within 7 days or we will be persuing all channels ie. Small Claims, IC3.gov as well USPS for mail fraud.

Proof of item working

This video shows that the item works flawlessly without being “plugged in” as the buyer stated. Again, further showing this buyer is dishonest and ultimately had a remorse purchase.

What was the outcome of the case?

Here is the outcome of this case.

2024-10-02 UPDATE: Buyer did end up sending the item back to us shortly after we sent the last message demanding the item or things would escalate further than they have (ie. Court).

2024-10-11 UPDATE: Case closed in buyers/sellers favor since they sent the item back which is what we wanted and they got their money back.
